Membership Agreement & Declaration

Membership Terms & Conditions

 

Principle Terms

1. This agreement commences once you have indicated your acceptance by completing this membership and declaration process.

2. This agreement will become binding between you and the gym once you complete the sign- up and checkout process for the membership, at which point a contract will come into existence between you and Hardy-Wallhead MMA Ltd. based on the Terms and Conditions laid out on the rest of this page/document.

3. You will be entitled to all the rights and privileges set for the Type of Membership chosen.

4. You cannot transfer this agreement to anyone else.

5. You can terminate your membership at any time. From the date of termination/cancellation,

you are still entitled to all the rights and privileges set forth by the membership you were subscribed to until the point the next payment is due, at which time your membership will then terminate. Meaning, regardless of when you terminate/cancel your membership, your last payment is non-refundable and your membership will remain valid until the next automated payment was due to be taken/made.

Direct Debit Fees and Charges

1. The first month's membership fees are collected by Debit/Credit Card at the time of purchase/sign-up on the website. Should any joining fees apply, they are in place to cover the initial administration costs associated with setting up a new membership etc.

2. Your second Direct Debit for monthly membership fees will only be collected one month after you joined. Subsequent Direct Debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.

3. If any Direct Debit is returned unpaid, or if any other form of payment is not honoured, for whatever reason, you shall pay an immediate fee of, at least, forty pounds UK Sterling (£40).

4. To cancel your Membership, you must email us at info@hardywallhead.co.uk advising us you wish to cancel your membership. Consider your email received when the sooner of these applies, either; when you receive a reply from us, or, after 7 days of you emailing us (you must show evidence you have emailed us with the correct email address, we reserve the right to consider the cancellation invalid if the email address is incorrect).

5. A monthly charge is applied if you freeze your membership. Your membership can be on freeze for a maximum of 3 months after which your membership will automatically be un- frozen and will revert to your monthly rate. Freeze only applies to monthly memberships and will start from your payment date after the request is made. Please be aware this must be actioned at least 3 working days prior to your payment date, and must be agreed by us in writing or via email.

6. You agree to advise us immediately of any change to the Members Details provided.

Direct Debit Prices

From time to time we may need to increase the price of membership. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will takeeffectandhowmuchyourmembershipwillcostaftertheincrease. Duringthisperiod,youwill have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.

 

Money Back Guarantee

As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your membership application form. However, as per regulation 36 of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to commence your membership immediately, or you ask us to start your membership early, you agree that if you subsequently cancel your membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used commencing from the first day after joining.

Health PAR-Q Member Information:

▪ Before starting any training program, it is important to ensure that you are fit and healthy to do so. Please read the following questions carefully and answer each one honestly.

▪ Has your doctor advised you not to do any physical exercise or training?

▪ Are you pregnant or postnatal?

▪ Do you suffer from asthma or breathing difficulties?

▪ Have you been in hospital in the last 3 years?

▪ Are you taking any medication?

▪ Do you suffer from diabetes or epilepsy?

▪ Do you suffer from an allergy?

▪ Has your doctor ever said you have a heart condition and should only do physical activity

recommended by a doctor?

▪ Do you ever feel pain in your chest when you do physical activity?

▪ In the past month, have you had chest pain when you were not doing physical activity?

▪ Do you lose your balance because of dizziness or do you ever lose consciousness?

▪ Do you have a bone or joint problem that could be made worse by a change in your physical

activity?

▪ Do you know of any other reason why you should not do physical activity?

Should the answer be “YES” to any of these questions, or you are uncertain of any of the answers, then please contact Hardy-Wallhead MMA on info@hardywallhead.co.uk before continuing with signing and training at this facility.

Hardy-Wallhead MMA Ltd Disclaimer:

A risk always exists when undertaking any form of exercise. A health problem or weakness may become apparent and could conceivably lead to injury, illness or fatality.

  

 

Our staff, agents and subcontractors are not medically trained, so should you have any concerns with your health, you should seek independent medical advice before engaging in any physical activity on our premises. It is strongly recommended that members (or non-members interested in training) refer to their GP for advice before starting any physical exercise at our facility or under our coaches tutelage. Upon joining, all members may request a comprehensive induction (fees applicable) to instruct you on the use of all gym equipment and we strongly advise to undertake this. Hardy-Wallhead MMA Limited will not accept any liability for any claim for personal injury during any form of physical activity whilst at the Hardy-Wallhead Gym or within its classes, sparring sessions or use of equipment. Members choosing to train at the gym or use any of its facilities do so understanding that Hardy- Wallhead MMA Ltd. are in no way liable for any sustained injuries and members, guests or trainers choose to use the facilities at their own risk. Under 16’s are not allowed to use the Gym equipment under any circumstances.

Martial arts are a potentially dangerous activity. Bumps, bruises, scrapes, scratches and soreness are commonplace, and most students will encounter this sort of minor injury from time to time in their training. More serious injuries are also possible, including sprains, strains, twists, cramps and injuries of similar magnitude and students can expect to encounter these injuries infrequently. The possibility of more serious injury exists, including fractured bones, broken bones, and torn ligaments, though not all students encounter such serious injuries. As with any physical activity, there also exists the remote possibility of crippling or death.

 

Members accept that Hardy-Wallhead MMA Ltd. are not liable for any such injuries etc. that members sustain whilst training at the facility, also understand that this includes injuries sustained through the training and sparring with other individuals, coaches and members, the risks involved in this are accepted and all liability is accepted by the member upon agreeing to this document. Hardy-Wallhead MMA Ltd, our staff, agents and subcontractors shall not be held responsible in the event of any injury, accident, illness or death which may result and can accept no liability other than in accordance with such duty as is implied by the Occupiers Liability Act 1984 as amended from time to time.

 

Member Agreement Declaration

You warrant, declare and acknowledge that:

▪ The information given by you upon joining is correct and will be relied upon by us.

▪ You have read and answered the Par-Q questionnaire honestly and that you have NOT

answered ‘yes’ to any of the questions.

▪ To the best of your knowledge and belief, you are in good health and not knowingly incapable

of engaging in either active, or passive exercise, and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your health or vulnerability to injury change.

▪ You have read and agree to Hardy-Wallhead MMA Gym Rules, Terms and Conditions of Membership.

▪ You have read and agree to Hardy-Wallhead MMA Gym Martial Arts Training Etiquette.

▪ You have read, understand and accept all risks associated with both gymnasium and martial arts training and completely absolve Hardy-Wallhead MMA Gym Ltd, the instructor(s), staff, agents and subcontractors of Hardy-Wallhead MMA Gym Ltd from any liability, accepting the

responsibility for your own safety.

▪ This agreement will become binding once you have checked the ‘I have read and accept the

Academy Rules, Terms and Conditions and Membership Agreement Declaration’ box and the

“JOIN NOW” button has been clicked.

▪ A written copy of this agreement can be requested at the Hardy-Wallhead MMA Gym

Reception.
